[2025:RJ-JP:2052] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 245/2025 1. Mahaveer S/o Bherulal, Aged About 40 Years, 2. Mohan Lal S/o Bherulal, Aged About 29 Years, Both R/o Raithal, Police Station Raithal, District Bundi (Raj.) (At Present Confined In District Jail, Bundi (Raj.). ----Accused-Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Govind Lal Choudhary, Adv. For Respondent(s) : Mr. N.S. Dhakad, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 15/01/2025 1. Learned counsel for the accused-petitioners seeks permission to withdraw the instant bail application qua the accused petitioner – Mahaveer. 2. Permission sought for is granted. Accordingly, the instant bail application qua the accused-petitioner – Mahaveer is dismissed as withdrawn. 3. Arguing the case of accused petitioner Mohan Lal, who is in custody in connection with FIR No.197/2024 registered at Police Station Raithal, District Bundi (Raj.) for the offences punishable under Sections 115(2), 126(2) and 189(2) of BNS, 2023, learned counsel submits that he has falsely been implicated in this case. Learned counsel submits that allegation of causing life-threatening injuries is against accused-petitioner – Mahaveer. He argues that there are no criminal antecedents against the petitioner – Mohan Lal and trial of the case will take considerable time. The petitioner [2025:RJ-JP:2052] (2 of 2) [CRLMB-245/2025] – Mohan Lal is in custody since 16.12.2024 and further custody of the petitioner would not serve any fruitful purpose. 4. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner, but, he fairly concedes that allegation of causing life-threatening injuries is against accused- Mahaveer. 5. I have considered the contentions. 6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner especially the fact that allegation of causing life threatening injuries is against accused Mahaveer; absence of criminal antecedents; trial will take time in its conclusion as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application qua the accused Mohan Lal. 7. This bail application is accordingly partly allowed and it is directed that accused-petitioner Mohan Lal S/o Bherulal shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
