GP FOR MED HEALTH AND FAMILY WELFARE The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... a writ of Mandamus by declaring the action of the Respondents No 4 and 5 to return the seized stock of 53 bags each containing 4 boxes and each box containing 50 small boxes each containing 22 Raja Khainees and total 212 boxes and in which 10,600 small boxes containing 2,33,200 Khainee packets and the total value is Rs.11,66,000/- without registering any FIR/crime on 16.09.2020 at 20.30Hrs near Nathavalasa Village on NH16 of Denkada Mandal of Vizianagaram District as illegal arbitrary and unconstitutional.” 2. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. 3. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that respondent-police handed over the seized case property to the Food Safety Officer, Vizianagaram for taking further action. 4. For ready reference, the written instructions are extracted hereunder: “I submit that having prepared occurrence report, on 17.09.2020 I have handed over seized case property Raja khaini packets total 2,33,200 packets and Van bearing No.AP 30 W 6109 to the 5th respondent Food Safety Officer, Vizianagaram for taking further action. I submit that the 4th respondent obtained acknowledgment from the 5th respondent the food safety officer, Vizianagaram for handing over the seized property Raja Khaini packets and van bearing no AP 30 W 6109 and now the matter is pending with 5th respondent the Food Safety Officer, Vizianagaram.” 5. Recoding the said submissions and the contents of the written instructions, the Writ Petition is disposed of. There shall be no order as to costs.
