Thakur, learned counsel for the petitioners. Also heard Mr. D. P. Goswami, learned Addl. P.P., Assam appearing for the State. This is an application under Section 483 of the BNSS, 2023 praying for grant of bail to the petitioners, who are related as husband and wife and have been in judicial custody since 12.08.2025 in connection with Gauripur P.S. Case No.355/2025 registered under Sections 22(c)/29 of the NDPS Act. The learned counsel for the petitioners has submitted that the Charge-sheet in the case has recently been laid after filing of this Bail Application and the same has been brought on record by way of an additional affidavit. In view of the aforesaid facts and circumstances, this Court is of the opinion that the petitioners be allowed the liberty to approach the learned Trial Court with appropriate petition seeking bail. The learned Trial Court on receipt of the said application shall take into consideration the fact that both the petitioners, who are related as husband and wife, have minor children of 9 years and 13 years respectively, stated by the learned counsel for the petitioners and the same shall be considered at the time when the bail application is preferred by the petitioners before the Trial Court as per law.
