By way of this petition, the petitioner is not challenging any particular order, but only seeking a direction from this Hon'ble Court to direct the respondent no. 2 to act upon and decide the representation of the petitioner against the final entry in the Annual Confidential Report (ACR) for the year 2022-2023, on the basis of recommendation dated 14-06-2024 (Annexure P-7) made by the reviewing authority. 2. Brief facts of the case are that the petitioner is an employee working under the respondent no.2 and the ACR of the petitioner for the year 2022-2023 was prepared wherein the performance of the petitioner was reviewed by the appropriate authority for the year 2022-2023 and Excellent' grade was recommended by the reporting authority but the reviewing and accepting authority downgraded it to 'Good'. Against the said final entry, the petitioner made a representation to the respondent authorities vide letter dated 15-03-2024 and the comments/suggestions were sought from the reviewing authority and the reviewing authority accepted the earlier mistake of downgrading the ACR without any legal basis and recommended to the respondent no.2 to treat the final entry as Excellent' vide recommendation dated 14-06-2024 (Annexure P- 7), but till date, the respondent no.2 has not acted upon and decided the issue, hampering the career prospects of the petitioner. Hence, this petition seeking kind indulgence of this Hon'ble court. 3 3. The petitioner most humbly pray for grant of the following relief(s):- 10.1 That, this Hon'ble Court may kindly be pleased to issue suitable writ/order/direction and direct the respondent no.2 to act upon and decide the representation of the petitioner against the final entry in the Annual Confidential Report (ACR) for the year 2022-2023, on the basis of recommendation dated 14-06-2024 (Annexure P-7) made by the reviewing authority within an outer limit of 2 weeks. 10.2 That, this Hon'ble court may further be pleased to award the cost of the petition to the petitioner. 10.3 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favor of the petitioner. 4. Learned counsel for the petitioner submits that the respondents authority have accepted this fact and they are going to consider his representation, as such at present he is only seeking that the respondent No.2 may be directed to decide his representation in view of Annexure-P/7 recommendation dated 14.06.2024. 5. Prayer seems to be fair and reasonable. 6. In view of the above, without commenting anything on merits respondent No.2 is directed to consider and decide the representation made by the petitioner within a period of 10 weeks. 7.
