The applicant, who is in custody since 01.06.2025, has approached this Court for grant of regular bail in connection with Special POCSO Case No.72 of 2025, arising out of Godda (Muffasil) Motia O.P P.S. Case No.94 of 2025, pending in the court of learned Special Judge (POCSO), Godda. 3. It appears that this applicant has been made an accused for committing the offence under Section 96 of BNS. The charge has been framed under Sections 96/ 64(2) (m) of BNS and Section 6 of POCSO Act. 4. It has been submitted by the learned counsel for the applicant that complete set of F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his/ her part. Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. The defence has been taken that the age of the victim is more than 18 years and further, it is consensual. On the above basis, prayer for bail has been made. 5. Learned A.P.P has opposed the prayer for bail. 6. The crime has been committed upon a minor and her consent carries no meaning. 7. Considering the materials available on record, I am not inclined to enlarge the applicant on bail. Accordingly, the prayer for bail of the applicant is, hereby, rejected.
