02/ 28.08.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Dhansar P.S. Case No. 24 of 2025, registered under sections 316 (2)/318(2) of BNS, 2023 pending in the Court of learned Judicial Magistrate, Ist Class, Dhanbad.

Learned counsel for the petitioner submits that petitioner and informant are friends and classmates and allegations are made that a sum of Rs.41,60,832/- was handed over to the petitioner which was invested in share market through Demat Account and it was agreed that 50% profit will be provided to each of the friends. He submits that however loss has occurred for that case has been lodged. He submits that petitioner has no criminal antecedent which is disclosed in para 12 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of handing over the amount to the petitioner which has been invested in Share Market through Demat Account and pursuant to that loss has occurred.

Looking into contents of F.I.R. it transpires that amount has

been handed over to the petitioner to invest in Share Market through Demat Account pursuant to that loss has occurred to the tune of Rs. 10-15 lakh and rest of the amount has already been transferred in Demat Account of the informant, the petitioner has no criminal antecedent, the petitioner is
directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
