Heard Sri B. Parameswara Rao, learned Counsel representing Sri K. Venkatesh, learned Counsel for the Writ Petitioner, Sri Sk. Abdul Rasheed, learned Assistant Government Pleader for Respondent Nos.1 & 2 and Sri Mulla Sohail Shareef, learned Counsel for Respondent No.3, Sri B. Abhay Siddhanth Mootha, leawrned Counsel for Respondent No.4 & 5. 2. The present Writ Petition is filed seeking the following relief: It is therefore prayed that this Hon’ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, Order or Direction declaring the action of the Respondents in not calling the fresh tenders by canceling the Preliminary Registration Certificates issued to those successful bidders, who failed to establish and operationalize Automated Testing Stations (ATS) within the stipulated time period in the districts of Dr.
B.R. Ambedkar Konaseema, West Godavari, Eluru, Krishna, Bapatla Palnadu, P.S. Nellore, Prakasam, and Tirupati, which is illegal, arbitrary and violation of Article 14 and 21 of Constitution of India. Consequently direct the Respondents to call for fresh tender (re tender) process and allow eligible new bidders, including the Petitioner, to participate in the establishment of ATS in the
aforementioned districts and Pass such other and further orders(s) as may be just, necessary and proper in the interest of justice. 3. Sri Sk. Abdul Rasheed, learned Assistant Government Pleader for Respondent Nos.1 & 2 has submitted the Written Instructions furnished by the Deputy Transport Commissioner (RS), dated 21.08.2025. Copy of it is supplied to the Counsel for the Writ Petitioner and the same is taken on record. 4. The Written Instructions indicate that out of 25 Automated Testing Stations for which bids were called, bids were received in respect of 23 Stations and they have been finalized. It is also submitted by the learned Government Pleader that about 17 Automated Testing Stations have commenced their operations. 5. Sri Sk. Abdul Rasheed, learned Assistant Government Pleader for Respondent Nos. 1 & 2, would submit that the tenders were called in the year 2022 and therefore some of the persons appointed for running Automated Testing Stations are likely to have their agreements expire. He would submit that the Government would initiate suitable action. 6.
Learned Counsel for the Writ Petitioner would submit that the non-filling up of the Automated Testing Stations is causing loss to the Government. The prayer sought in the present Writ Petition is vague in nature and the same cannot be entertained.
7. In this view of the matter, Writ Petition is dismissed as being devoid of any merit. No order as to costs.
8. Interlocutory Applications, if any, stand closed in terms of this order.
