Case No.58 of 2025 registered for the offences punishable under Section 126 (2), 115 (2), 109, 303 (2), 329 (4), 352, 351 (2), 351 (3), 3 (5) of the B.N.S., 2023 and Section 3/4 the Witchcraft (Daain) Practices Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner attempted to commit murder of Shobha Devi and called her a Daain and he also committed theft of Rs.1,05,000/-, ear-rings, silver chain, gold chain and also assaulted the informant with intention to kill him causing injuries to him. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards page No.-32 (Annexure-3) of the brief, which is the copy of the certified copy of the compromise petition filed by the parties in the court of learned S.D.J.M, Godda in connection with Pathargama P.S. Case No.58 of 2025, learned counsel for the petitioner submits that a compromise has taken place between the parties, hence, the informant is not ready and willing to pursue this case. It is further submitted that the because of a petty dispute between the parties, the same resulted in the alleged occurrence. Drawing attention of this Court towards para-19 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is also submitted that charge-sheet has already been submitted in this case. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the informant and other witnesses of the case during the trial of the case. It is lastly submitted that the petitioner has been in custody since 11.06.2025 as is evident from para-22 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Godda in connection with Pathargama P.S. Case No.58 of 2025 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant and other witnesses of the case during the trial of the case.
