The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No. 282 of 2025, for the alleged offences registered under Sections 127(1)/ 115(2) / 109 / 303(2)/ 3(5) of the Bhartiya Nyaya Sanhita 2023, pending in the Court of learned Judicial Magistrate, First Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that there are general and omnibus allegations against all the accused persons. Petitioner is aged about 75 years and there is no overt act allegation, so far as the petitioner is concerned. He submits that due to raising of the boundary wall, the scuffle took place and both the sides are family members and there is case and counter case between the parties. 4. Learned counsel for the State opposed the prayer and submits that the allegations are there. 5. In view of the above and considering that there are general and ( 2025:JHHC:26545 2 omnibus allegations against the petitioner, there is case and counter case between the parties and the petitioner is aged about 75 years and there is no allegation of any overt act against the petitioner, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate First Class, Dhanbad, in connection with Govindpur P.S. Case No. 282 of 2025, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023. 7. This Anticipatory Bail Application is accordingly disposed of.
