The petitioner has been made accused in connection Mirzachowki P.S. Case No.03 of 2025 registered for the offences punishable under Section 109 and 61 (2) of the B.N.S., 2023 and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in criminal conspiracy with the co- accused persons, has committed the murder of Holy Koda. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-11 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is next submitted that though the petitioner is not named in the F.I.R. yet he has been implicated in this case only on the basis of confessional statement of the co-accused. It is further submitted that the allegation of firing upon the deceased, is against Rajendra Bind in the F.I.R and in the confessional statement of the co-accused, firing was alleged to have been made by Rabi and Dhiraj Vishwakarma @ Siti. It is further submitted that the co-accused, with similar allegations, have already been admitted to bail by this Court vide orders dated 12.06.2025 and 19.06.2025 passed in B.A. No.4025 of 2025 and 4801 of 2025 respectively. It is also submitted that charge-sheet has already been submitted in this case. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the informant and other witnesses of the case during the trial of the case. It is lastly submitted that the petitioner has been in custody since 01.05.2025 as is evident from para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sahibganj in connection with Mirzachowki P.S. Case No.03 of 2025 with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant and other witnesses of the case during the trial of the case.
