HONOURABLE SRI JUSTICE RAVI NATH TILHARI HONOURABLE SRI JUSTICE CHALLA GUNARANJAN CIVIL MISCELLANEOUS APPEAL NOs.266 & 311 of 2007 COMMON JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari) CMA.No.266 of 2007 has been filed by the husband being aggrieved from the decree of restitution of conjugal rights granted on the petition of respondent-wife in O.P.No.49 of 2002. 2. CMA.No.311 of 2007 has been filed by the husband being aggrieved from the dismissal of his petition for divorce in O.P.No.120 of 2002. 3. On 12.12.2023, the CMA.No.266 of 2007 was dismissed for non- prosecution. Further the appeal was restored on the applications filed and the order of dismissal was set aside on 27.11.2024. 4. On 11.9.2024, the CMA.No.311 of 2007 was dismissed for default. Further the appeal was restored on the applications filed and the order of dismissal was set aside on 12.12.2024. 5. On 26.12.2024 at the request of learned counsel for the appellant, the matters were directed to be posted on 09.01.2025. 6. On 09.01.2025, again at request of learned counsel for the appellant, the matters were directed to be listed after Sankranthi Vacation, 2025. 7. Today, there is no representation on either side even in the revised call. 2 8. The matters pertain to the year 2007 and are listed in the weekly cause-list. 9. In view of the above, the Civil Miscellaneous Appeals are dismissed for “want of prosecution”. No order as to costs.
