Petitioner has been made accused in connection with T. Tanger P.S. Case No. 58 of 2022 corresponding to Special POCSO Case No. 03 of 2023 for the offences registered under sections 376DA, 341, 323,325 and 34 of the Indian Penal Code and section 4, 6, 8 and 12 of POCSO Act, pending in the court of learned Additional Sessions Judge-cum-Special Judge (POCSO), Simdega. 3. On 03.11.2022, petitioner and co-accused persons are alleged to have gangraped the victim. 4. It appears that out of eleven witnesses, ten witnesses have already been examined and the prosecution has filed a petition under section 311 of the Cr. P.C. for evidence. 5. Considering the nature of allegation and the fact that the trial is at the fag end of its conclusion, I am not inclined to release the petitioner on bail.
