Pathak, Advocate ---- 04/10.09.2025 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Chandrapura P.S. Case No.142 of 2023 corresponding to G.R. Case No.1176 of 2023 for the alleged offences registered under Sections 380 and 457 of Indian Penal Code, pending in the Court of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the confessional statement and the allegations are made that theft was committed in the house of the informant. She submits that the petitioner has received the notice under Section 41A of Cr.P.C. 4. Learned counsel appearing for the State opposes the prayer and submits that the name of the petitioner has come on the 2025:JHHC:27532 --2-- A.B.A. No. 5217 of 2025 confessional statement and the petitioner is avoiding his appearance. 5. In view of the above and considering that the petitioner has received the notice under Section 41A of Cr.P.C and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
