The petitioner has been made accused in connection with Garhwa P.S. Case No. 177 of 2021, for the offence registered under Sections 302, 120B, 307 & 379 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Garhwa. F.I.R. was instituted on the basis of the fardbeyan of the informant Sargam Gaurav, alleging therein that on 28.04.2021 at about 04:15 p.m., her husband had gone to Sonpurwa bus stand, where he worked as agent. After an hour she received phone call that her husband has been shot. She went to the place of occurrence where she saw her husband and Kail Dubey lying there with fire arm injury. He was taken to the hospital, where he succumbed to his injuries. It was submitted that name of the petitioner has transpired in the confession of the co-accused and the case of the petitioner stands on similar footing of the co- accused, who have been granted bail by a Coordinate Bench of this Court in B.A. Nos.9105 of 2021, 8357 of 2021 and 8181 of 2021. It was further submitted that co-accused Suhail Ahmad and co-accused Riyajuddin Rangsaj @ Chhotu Rangsaj @ Wajuddin Rangsaj have been granted bail by this Court earlier. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S.
