Since both the petitions arise out of similar FIR bearing Crime No.0213/2022 registered at Police Station Darri, District Korba (C.G.) dated 03.08.2022, they have been clubbed together, heard together and disposed of by this common order. 2. Heard Mr. Pragalbha Sharma, learned counsel for the petitioner in CRMP No.1366/2023, Mr. Vijay Kumar Sahu, learned counsel for the petitioner in CRMP No.1855/2022, Ms. Soumya Sharma, learned Panel Lawyer, appearing for the State/respondent No.1 and Mr. Anil Gulati, Mr. Rajkamal Singh (though VC), Mr. Suryaparatap Yuddhveer Singh and Mr. Suresh Tandon, learned counsel appearing for the respective respondents. 3. CRMP No.1366/2023 has been filed by the petitioner with the following relief(s):- “It is, therefore prayed that F.I.R. dated 03.08.2022 having its Crime No.213/2022 registered by P.S. Darri, Korba, District Korba (C.G.) for the alleged offence punishable under Section 420 r/w 34 of the Indian Penal Code, 1860 (Annexure P/1) be quashed.” 4 4. CRMP No.1855/2022 has been filed by the petitioner with the following relief(s):- “Therefore, it is prayed that this Hon’ble Court may kindly be pleased to allowed the present petition and directed the concern officer of Police station Darri, Korba, C.G. for fair and speedy investigation in Crime No.213/2022 and arrested the respondents as soon as, in the interest of justice.” 5. Learned counsel for the petitioners jointly submit that a closure report has been filed in the matter on 17.08.2023. In view thereof, they pray for permission to withdraw these petitions, with liberty to take recourse to law, as may be available to them. 6. It is an admitted position that CRMP No.1366/2023 has been filed by one of the accused, whereas CRMP No.1855/2023 has been filed by the complainant. 7. Learned State counsel confirms the submission made by the learned counsel for the petitioners regarding the filing of the closure report on 17.08.2023. 8. In view of the above facts and circumstances, both the petitions are dismissed as withdrawn, with liberty to the petitioners to take recourse to law, if so advised.
