D/L 71 22.05.2025 ct. no. 35 Kausik W.P.A. 10756 of 2025 Abdul Khaleque @ Abdul Khalek Mondal & Ors. Versus The State of West Bengal & Ors. Ms. Papiya Chattopadhyay …for the petitioner. Mr. Y. Mondal …for the private respondents. Mr. Santanu Kumar Mitra, Sr. Govt. Adv. Ms. Anandamoyee Ghosh …for the State. Petitioner complains that he is unable to enjoy the property as there has been disturbance and interference caused at the behest of the private respondents. To that effect, police authorities have been repeatedly informed. But the police authorities did not act in accordance with law. Consequently, the petitioner is faced with severe inconveniences. Learned advocate for the private respondents submits that a civil suit is pending wherein an interim order has been passed restraining the present petitioner. In respect of status quo order the respondents are facing inconveniences. Police authorities have drawn up proceedings under section 126 of the BNSS. Police 2 report also reflects that the property is an undemarcated property and there are disputes amongst the co-sharers. Having considered the police report and the submissions advanced by the learned advocate appearing for the petitioner as well as the private respondents, I am of the view that the police authorities would continue their vigil and ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the inimical relationship existing between the parties. With the aforesaid observations WPA 10756 of 2025 is disposed of. Report so submitted be kept with the record. Copy of the report be handed over to the learned advocate appearing for both the parties. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
