K K KOMALAN COUNSEL FOR THE RESPONDENT : PUBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER t> 2 Order: The Criminal Petition, under Sections 483(1) and 484(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brev'lty [the BNSS'), has been filed seeking to modify the condition imposed on the petitioner/Accused No.2 in the order dated 16.O3.2024 passed in Crl.MP.No.159 of 2024 by the learned MetropoI'ltan Sessions -Judge-Gum-I Additional District & Sessions Judge-Gum-Special Judge for trial of Offences under the NDPS Act, Visakhapatnam. 2. A case has been registered against the petitioner herein and another in crime No.314 of 2023 of II Town Police Station, Visakhapatnam City, for the offences punishable under Sections 20(b)(ii)(B) r/w 8(C) of the NDPS Act, 1985. 3. The learned Metropolitan Sessions Judge-Gum-I Additional District & sessions Judge, Visakhapatnam, granted bail to the A-1 and A-2 in CrI.MP.No.159 of 2024, on condition that the A-1 and A-2 shall execute a self bond ,for a sum of Rs.1,00,000/-(Rupees One Lakh only) each with two sureties for a like sum each to the satisfaction of the [[ Additional Chief Metropolitan Magistrate, VisakhaPatnam. 4. The present Criminal Petition is filed on the ground that the petitioner herein i]e., A-2 could not be in a position to furnish bond for Rs.1,00,000/-and though the bail order was passed on 16.03.2024, till today, df fro 3 the petitioner could not get himself released on bail, hence he urged to modify the conditions imposed by the Court below. 5. ln view of the aforesaid facts and circumstances, this Court is inclined to modify the condition imposed by the Court below. Accordingly, the condition imposed by the learned Metropolitan Sessions Judge-Gum-I Additional District & Sessions Judge-Gum-Special Judge for trial of Offences under the NDPS Act, Visakhapatnam, in the order in Crl.MP.No.159 of 2024, dated 16.03.2024, is modified to the extent that the petitioner herein i.e., A-2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for the like sum each to the satisfaction of the learned ll Additional Chief Metropolitan Magistrate, Visakhapatnam. 6. Accordingly, the Criminal Petition is allowed.
