This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner, namely Shri Ajay Timung, apprehending arrest in connection with Bogijan P.S. Case No. 29/2025 registered under Page No.# 2/2 Sections 109/ 115(2)/ 118(2)/ 296 of BNS, 2023 read with Sections 25(1)(a)/ 27 of the Arms Act. The allegation in the FIR reveal that the petitioner who was a grass cutter serving in the Forest Department had assaulted the informant and some of his friends when the informant had burst crackers to chase away elephants. It is also the allegation that the petitioner had fired two shots from the gun of the forest Guard. Case diary as called for is received and it appears that the statement has already been recorded by the I.O. On perusal of the case diary there appears to be the materials against the petitioner. However, perusal of the medical report only indicates simple injury to the toes of the injured persons. Having regard to the nature of the allegation and the progress of the investigation, prayer for pre-arrest bail is allowed. Accordingly, interim order dated 19.12.2025 is hereby made absolute subject to the conditions mentioned in the said interim order itself The bail application is disposed of. Send back the case diary.
