-----
CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
-----
For the Petitioner : Mr. Pramod Kumar Choudhary, Advocate For the State
: Mr. Satish Kumar Keshri, A.P.P.
-----
04/10.09.2025 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Balidih P.S. Case No.50/2025, registered for the offence under Sections 127(1), 115(2), 352, 351(2), 308(3), 303(2), 109, 3(5) of the BNS, 2023, pending in the Court of the learned Chief Judicial Magistrate, Bokaro.
3.
Learned counsel for the petitioner submits that false allegation has been made against the petitioner and two FIRs have been lodged and it is not possible that the petitioner will be available at two different places at the same time. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner.
4.
Learned counsel for the State opposed the prayer and submits that even the petitioner is having criminal antecedent.
5. It transpires that the petitioner is named in the FIR and there is direct allegation against him that he used to demand levy from the informant and assaulted the informant by entering into the office of Hassan Seikh and the informant has sustained injury over his head. It also transpires that the petitioner is having criminal antecedent and in the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is rejected.
6. Accordingly, this application is dismissed.
