Page No.# 2/3 BEFORE HONOURABLE MR. JUSTICE BUDI HABUNG ORDER Date : 03.12.2025 Heard Mr. M. G. Singh, learned counsel for the applicant/election petitioner. Also heard Mr. M. Opo, learned counsel for the sole respondent.
2. On 28.10.2025, this Court framed altogether eleven (11) Issues, including the Issue Nos. 7 and 9, which read as follows:
“7. Whether the respondent elected candidate is guilty of corrupt practices as defined under section 123(2) of the Representation of People Act, 1951, so more particularly, for alleged booth capturing malpractices and rigging at the polling stations pleaded in the petition.
9. Whether the allegation of booth capturing, malpractice, rigging etc. lacks material particulars as required under section 135A Representation of the People Act, 1951, for making out a cause of action of commission of corrupt practice under section 100(1) (b) Representation of the People Act, 1951.”
3. By filing this interlocutory application, the applicant/election petitioner prays for dropping/deletion of the Issue Nos. 7 and 9, which was framed by this Court on 28.10.2025, on the ground that the said issues are not being pursued.
4. The learned counsel for the respondent has no objection to the prayer made in the present application.
5. In view of the above, and since both sides have agreed, this Court finds no
Page No.# 3/3 impediment in allowing the prayer of the applicant/election petitioner for deletion/dropping of the Issue Nos. 7 and 9 from the issues framed by this Court.
6. Accordingly, the I.A. is allowed by dropping/deleting the Issue Nos. 7 and 9 from the issues framed by this Court on 28.10.2025.
7. With the above, the I.A. stands disposed of. JUDGE Comparing Assistant
