This Court, vide order dated 06.05.2024 passed in MCRC No. 2671 of 2024, while rejecting the bail to the applicants, namely, Nitin Gajghate and Khushal Pande had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of passing of the order, if there was no legal impediment. 3. Earlier on one occasion also, this Court had granted extension of time KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 for compliance of the order dated 06.05.2024. 4. The learned Special Judge (NDPS Act), Saraipali District- Mahasamund (C.G.) vide his request letter dated 05.05.2025 has requested for grant of some more time for concluding the trial. 5. It transpires from perusal of the PUD, that as per the trial schedule, the evidence of 15 prosecution witnesses are to be recorded in the present case. Despite the continuous issuance of summons, bailable warrants and arrest warrants to the witnesses, their evidence could not be recorded due to their non-appearance. The present presiding officer assumed charge as Special Judge, NDPS, on 26.03.2025. The case was placed before him for the first time on 05.05.2025 for trial. The case was thereafter listed on 28.05.2025, 29.05.2025, and 30.05.2025 for prosecution evidence and bailable warrants were issued to the witnesses through the Superintendent of Police, Mahasamund. After recording the evidence of all 15 prosecution witnesses, the statement of the accused, final arguments and defence evidence are yet to be taken. Therefore, it does not appear possible to conclude the trial within the time prescribed by this Court. 6. The request appears to be reasonable. The concerned trial Court is directed to conclude the trial as early as possible, preferably within a further period of four months from today. 7. Accordingly, this CRMP stands disposed off with the aforesaid direction. 8.
