1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 24/2025 registered at Police Station Kotwali Jhalawar, District Jhalawar for the offences under Section 137(2) of BNS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the prosecutrix has been examined as PW-1 'X' before the Trial Court and in her deposition, she has stated that petitioner- Rohit @ Golu did not establish any sexual relationship with her. She has also stated in her cross-examination that her mother and father used to fight with each other and many a

On the day of incident, her mother and father were talking to each other about locking her in the room and after hearing their talks, she left her house. Petitioner- Rohit was known to her and she left her house with her own wish, the petitioner did not commit any sexual offence with her. It is also contended that her statement recorded under Sections 180 and 183 of BNSS and later on in the Court statement, there are several contradictions. Learned Trial Court rejected the petitioner's bail application on the grounds of petitioner's criminal antecedents, however, in the case referred in the order, in 3 cases against the petitioner pertains to offence under Section 303 of the BNS which is pending before the Court. The accused-petitioner is in custody since long and further trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has submitted the intimation report served upon the victim/complainant. The same is taken on record. 4. No one has appeared on behalf of the complainant after due intimation. 5. Learned Public Prosecutor has vehemently opposed the bail application. 6. Heard and perused the material available on record. 7. It is not desirable to express anything on the merits of the case. PW-1 prosecutrix 'X' has already been examined by the Trial Court. In the four cases shown against the petitioner about his indulgence in criminal cases, in 3 cases petitioner have been acquitted. The accused-petitioner is in custody since long and
[2025:RJ-JP:33902] (3 of 3) [CRLMB-8730/2025] further trial of the case may take considerable time, considering the above facts, I deem it just and proper to enlarge the accused- petitioner on bail. 8.
Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rohit @ Golu S/o Shri Ganesh, in connection with FIR No. 24/2025 registered at Police Station Kotwali Jhalawar, District Jhalawar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
