At the very outset, Mr. Gupta, the learned counsel appearing for respondents No.4 to 11 would submit that the order passed by the Joint Registrar, Cooperative Societies is appealable according to the provisions of Section 78 of the Chhattisgarh Cooperative Societies Act, 1960. 2. At this stage, Mr. Pradhan, the learned counsel appearing for the petitioner would seek permission of this Court to withdraw this petition with liberty to avail remedy available under the law. 3. Permission is granted. 4. With the liberty as prayed for, the present petition is dismissed as withdrawn. 5. It is expected that the Appellate authority would consider the issue of limitation taking a lenient view as a matter remained pending before this Court for a considerable period. 6.
