1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.140/2025 registered at Police Station – Palari, District – Balodabazar Bhatapara (C.G.) for the offences punishable under Sections 316 (5) and 3 (5) of the Bhartiya Nyaya Sanhita, 2023.

The prosecution story, in brief, is that as per the the FIR registered at Police Station – Palari, District – Balodabazar-Bhatapara, the complainant, Sanjay Kumar Verma, submitted a written complaint stating that between 14.11.2024 and 24.04.2025, a total of 54,905 quintals of paddy was purchased at the paddy procurement center. However, during the inspection, 368.78 quintals were found missing, causing a loss of Rs.8,48,194/-. The applicant, being the manager, has also been held responsible for this shortage. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has neither committed nor participated in any such alleged act. He submits that the applicant is having family responsibility being sole bread earner and his family is totally dependent upon him. He further submits that the applicant is not associated with other co-accused in the instant crime of casing loss of paddy. Therefore, he prays that the applicant may be granted anticipatory bail.
4. On the other hand, learned State counsel opposed the anticipatory bail application of the applicant.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, submissions of learned counsel for the parties, nature of dispute and material available in the case diary and further the fact that the applicant is involved in misappropriation of government paddy (368.78 quintals) worth of Rs.08,48,194/-, therefore, I am not inclined to grant anticipatory bail to the applicant.
7. Accordingly, the bail application of the applicant – Panch Ram Dhruw, involved in Crime No.140/2025 registered at Police Station – Palari, District – Balodabazar Bhatapara (C.G.) for the offences punishable under Sections 316 (5) and 3 (5) of the Bhartiya Nyaya Sanhita, 2023, is rejected.
8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance.
