[2025:RJ-JP:31197] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 10617/2025 Indermal Jain S/o Sobhagmal Jain, Aged About 69 Years, R/o Maharana Pratap Bazaar, Purani Tonk, Tonk. ----Petitioner Versus Rajasthan State Financial Corporation, Through Manager, Cfc Building, Riico Office, Sitapura, Jaipur-302033. ----Respondent For Petitioner(s) : Mr. Ankit Bishnoi HON'BLE MR. JUSTICE SAMEER JAIN
Judgment 12/08/2025
Learned counsel for the petitioner has submitted that documents taken by the respondent-RFC qua collateral security for sanction of loan/working capital are not released, thereby causing impediment upon the petitioner. Learned counsel has relied upon condition No.16 which reads as under:
“16. The partners shall submit the collateral security of immovable property, the value of which should not be less than the RFC working capital loan.” It is further submitted that the respondent has never sanctioned the loan qua working capital, therefore, retaining documents as a collateral for more than a decade is unwarranted. Considering the foregoing facts and circumstances of the case, this Court directs the respondent-RFC/competent officer to consider the representation within a period of 30 days from the date of filing, in accordance with law. Further, the petitioner is
directed to file the representation before the respondent within a period of seven days from the date of passing of this order.
[2025:RJ-JP:31197] (2 of 2) [CW-10617/2025] In view of the above, the present petition is disposed of. Pending applications, if any, shall stand disposed of.
