This is defendant's petition. This writ petition has been filed with the following prayer : "Issue an order or direction directing the Learned Civil Judge (Junior Division) City Azamgarh to decide the 7C 2 Application for Interim Injunction filed under Order 39 Rule 1 and 2 of Code of Civil Procedure in Original Suit being Suit No. 1443 of 2024 (Shahbaz vs. Abdul Quddush) in time frame without any further delay, in the better interest of justice." It is contended that in a suit instituted by the plaintiff-respondent, an application 7C(2) for grant of temporary injunction has been moved under Order XXXIX, Rule 1 and 2 C.P.C., which is pending consideration. The sole prayer made in the writ petiton is for expeditious disposal of the said application. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge (Junior Division), City Azamgarh to decide the temporary injunction application (7-C2) filed in Suit No.1443 of 2024 (Shahbaz vs. Abdul Quddush), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
