Mr. Raman Sharma, learned AAG fairly submits that the petitioner may not be interested in prosecuting the instant petition in light of the decision taken by the Government of Jammu and Kashmir, Health and Medical Education Department, wherein a conscious decision has been taken that the projects where physical progress is less than 20% should be dropped. 02. In the light of the aforesaid decision and also in light of the stand taken by the respondents in the reply wherein the respondents have specifically stated that the construction project at ISM (now Ayush) Dispensary Gundha was dropped in the meeting held under the Chairmanship of the then Financial Commissioner (Additional Chief Secretary), Health & S. No. 11 2 WP(C) No.516/2022 Medical Education Department on 7th December, 2021, while reviewing the status of implementation of the projects of Health & Medical Education Department under NABARD. Learned counsel appearing for the respondents further pleaded that since the project of ISM (now Ayush) Dispensary Gundha was not even completed 20% after five years of start of construction work and was termed as slow and non-starter, accordingly, a decision was taken by the Government to drop the same. 03. Thus, in the light of the decision taken by the Government which finds mentioned in the Minutes of Meeting held on 07.12.2024 under the Chairmanship of the then Financial Commissioner (Additional Chief Secretary) Health & Medical Education Department, nothing remains to be adjudicated any further in the instant petition, as the same has been rendered infructuous. This is the precise reason that there is no representation on behalf of the petitioner. 04. Accordingly, the instant petition is dismissed as having been rendered infructuous. 05. Interim direction, if any, shall stand vacated.
