D.Ramachandra Reddy who had been allotted a site bearing No.665 at Ward No.82, Hoysala Nagara, Binnamangala 1st stage, Bengaluru measuring East to West on the northern side 47 feet, North to South on the eastern side 60.06 feet, south by 46.04 feet and West by 61 feet, in the layout which was formed by the then Bengaluru City Improvement Trust Board, are before this Court seeking following reliefs; "a) Issue a writ in the nature of mandamus directing the respondents to execute the reconveyance deed/sale deed in favour of the petitioners jointly in respect of the site bearing No.665 situated at Binnamangala, Bengaluru City, Bengaluru. b) Issue such other appropriate writ or order or direction as this Hon'ble Court deems fit to grant under circumstances of the case in the interest of justice and equity." - 3 - NC: 2025:KHC:8881 WP No. 19193 of 2021 2. Case of the petitioners is that said site had been allotted to their father D.Ramachandra Reddy and an agreement was registered by the then CITB in his favour on 15.03.1975. That ever since then he was in possession of the property in question. Said D.Ramachandra Reddy had three sons and four daughters. He had executed a Will dated 01.08.1980 and the said D.Ramachandra Reddy passed away on 11.02.1981. That in terms of the aforesaid Will he had bequeathed the subject property in favour of petitioners herein. There was a condition in the Will that upon his demise the said property would be enjoyed by his wife Gowramma during her lifetime and only thereafter the property would devolve in favour of the petitioners. That the said Gowramma passed away on 04.04.1998 thereafter the petitioners approached the respondent-BDA seeking conveyance of the property in their names which has not been effected till date. Hence, the petition. 3. Learned counsel for the respondent-BDA drawing attention of this Court to the documents at Annexure-G submits that the petitioners were called upon to furnish the documents enlisted in the said notice at Annexure-G and if the - 4 - NC: 2025:KHC:8881 WP No. 19193 of 2021 petitioners furnished the said documents their case would be considered in accordance with law. 4. Submission is taken on record. 5. Accordingly, the following; ORDER (1) Petition is disposed of. (2) Petitioners are at liberty to submit the documents as called for by the respondent- BDA as per Annexure-G within a period of 30 days from the date of receipt of certified copy of this order. (3) Upon such submission, respondent-BDA shall consider the case of the petitioners and do the needful within an outer limit of eight (8) weeks thereafter. Sd/- (M.G.S.
