The petitioner is apprehending his arrest in connection with Hanwara P.S. Case No.49 of 2024, arising from POCSO Case No.34 of 2025, for offence registered under section 75 and 79 of BNS, 2023 and section 12 of POCSO Act, pending in court of learned Additional Sessions Judge-I Cum Special Judge (POCSO), Godda.

Learned counsel for the petitioner submits that police has investigated the case and submitted final form saying lack of evidence. He submits that learned trial court differing with the final form has been pleased to take cognizance against the petitioner and summon has been issued to the petitioner. He submits that petitioner is innocent and that has been fully investigated by the police and in view of that the anticipatory bail may kindly be granted.
4. Learned State counsel opposes prayer and submits that learned court has found the materials against the petitioner and in view of that it has taken cognizance.
5. In view of above and considering that final form has been submitted saying lack of evidence and the learned court has taken cognizance, and in that view of the matter, petitioner above named is
directed to surrender before learned court within two weeks from today and learned court shall release petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. This petition is disposed of.
