I.A. No. 10467 of 2024
Heard the learned counsel for the respective parties. This application has been preferred by the appellant for condoning a delay of 152 days in filing the appeal. Having been satisfied with the reasons assigned in this application, the delay of 152 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of. L.P.A. No. 556 of 2024
This appeal is directed against the order dated 23.02.2024, passed in WP(S) No. 184 of 2019, by the learned Single Judge, whereby and whereunder, the prayer which has been made by the writ petitioner- appellant challenging the appointment of the respondent no.4 on compassionate ground has been rejected. The husband of the appellant-writ petitioner was working as a Mechanic Khalasi, Grade-I, DLS/BMDM under the Divisional Superintendent, South Eastern Railway, Bondamunda who was given voluntary retirement on 20.08.1981. It has been claimed by the writ petitioner that the respondent no.4 had got an appointment in place of the

husband of the writ petitioner and continued in the same and such appointment was challenged by the writ petitioner in WP(S) No. 184 of 2019 which was dismissed on 23.02.2024. It seems that the respondent no.4 after completing his service tenure had already superannuated and after almost 37 years the writ petition was preferred by the writ petitioner claiming that the employment secured by the respondent no.4 was a fraud committed upon the Railways as well as upon the writ petitioner.
The learned Single Judge has correctly appreciated the inordinate delay in filing the writ application and had accordingly dismissed the writ application. We do not find any reason to entertain this appeal. Consequently, the same stands dismissed as well. (RONGON MUKHOPADHYAY, J.)
