GP FOR REVENUE (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ of Mandamus to declare the action of the respondent Nos 1 to 4 in passing the exparte Impugned orders dt 10.08.2020 under Sec 145 of Cr.P.C. and thereby preventing the petitioner and his family members to reside in the residence of the petitioner and functioning as Pastor in Siyonu Prayer House without following due process of law as arbitrary illegal and violation of Article 21 of the Constitution of India and consequently direct the respondent Nos.1 to 4 not to obstruct the petitioner to reside in the Church Building and functioning as Pastor and set aside the Impugned orders dt 10.08.2020 passed by the 4th respondent under Sec 145 of Cr.P.C in the interest of justice” 2. Heard Sri P.Nagendra Reddy, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that impugning the orders passed by the Tahsildar under Section 145 Cr.P.C. dated 10.08.2020, the present petition is filed. Learned counsel would further submit that in the light of the lapse of five years the orders are not in force and the petition may be disposed of giving liberty to the petitioner to file a fresh petition in case the grievance is not resolved. 4. Learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders. 5. Considering the submissions made and since the impugned order is not in force, the Writ Petition is disposed of. However, the petitioner is at liberty to 3 file a fresh petition in case his grievance is not resolved. There shall be no order as to costs.
