Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 23/01/2025 1) By way of this petition, petitioner has sought following relief(s):- 10.1 That, this Hon'ble Court may kindly be pleased to direct respondent-authorities for releasing of difference of compensation in light of order dated 03/12/2018 passed in Revenue Case No. 10/A-67/2017-18 village Khamhriya, Tahsil Tamnar, District Raigarh (C.G.) and on the basis of Extraordinary Gazette Notification dated 02/05/2019. 2 10.2 That, this Hon'ble Court may kindly be direct the respondents authorities for payment of interest under Section 80 of the Act, 2013. 10.3 That, this Hon'ble Court may kindly direct the respondent- authorities for taking decision upon the representation of the petitioner and for recalculating the compensation on the basis of new notification and payment of the difference amount to the petitioner in light of new notification. 10.4 Any other relief/ order may also be granted that may be deemed fit and just in the facts and circumstances of the case. 2) Learned counsel for the petitioner submits that petitioner is the owner and title holder of lands bearing Khasra Nos. 9, 47/1, 50/2, 10/1 and 10/2 ad-measuring 1.170, 2.987, 0.041, 1.594 and 0.405 hectares respectively situated over Village Khamhariya, Teshil-Tamnar, District- Raigarh (C.G.). She furthers submits that lands stated above were acquired by the respondents but compensation was not paid adequately by the Land Acquisition Officer. She contends that interest on delayed payment has also not been made to petitioner. She further contends that representation (Annexure P/3) was submitted before Collector, Raigarh but till date, no decision has been taken. She prays that a direction may be issued to Collector, Raigarh to decide the pending representation. 3) On the other hand, learned State counsel submits that if representation made by petitioner is pending consideration before the Collector, Raigarh, same would be decided strictly in accordance with law. 4) Heard. 5) Taking into consideration the submission made by respective counsel for the parties, this petition is disposed of directing Collector, Raigarh 3 to decide the pending representation (Annexure P/3) moved by petitioner expeditiously strictly in accordance with law. 6) Petitioner would be at liberty to make fresh representation ventilating his grievance(s).
