By this application, the applicant-respondent no.2 is seeking the modification to the order dated 7.6.2023. 3. It is the contention of the respondent no.2 that during the pendency of the present appeal, the respondent no.1 was expired on 19.12.2024 leaving behind the respondent nos.2 and 3 as a surviving legal heirs. 4. By the present application, the prayer is made that the respondent no.2 be permitted to withdraw the amount by modifying the order. In view of the application filed by the respondent no.2, this court, by order dated 18.4.2026, directed the respondent no.3 to file the additional affidavit in support of the application. 5. Today, across the bar, the affidavit of the respondent no.3 is circulated. The same is taken on record. By this affidavit, the respondent no.3 stated that he has no objection if the entire 2026:BHC-NAG:8131 2 50 FA 534.23.odt amount is withdrawn by the respondent no.2, who is the wife of respondent no.1 and the mother of respondent no.3. 6. In view of this factual position, the order dated 7.6.2023 passed in Civil Application (CAF) No.1373/2023 is modified as under : “Respondent Nos.1 and 2 recorded in the order be substituted as Respondent No.1 and in place of Rs.5,00,000/-, same shall be replaced as Rs.10,00,000/-.” 7.
