2. Petitioner has been made accused in connection with S.T. Case No. 235 of 2022 arising out of Basia P.S. Case No. 31 of 2020 corresponding to Spt. G.R. No. 155 of 2021 for the offences registered under sections 307, 302 and 120(B) of the Indian Penal Code and section 27 of Arms Act, pending in the court of learned Additional Sessions Judge-II, Gumla.
3. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 629 of 2023 by order dated 31.03.2023.
4. Petitioner is alleged to have shot Vikash Mishra, due to which, he succumbed to his injuries.
5. Stage of trial earlier called for, has been received. It appears that out of eight charge sheet witnesses, five witnesses have already been examined.
6. Considering the nature of allegation and the fact that the trial is at fag end of its conclusion, I am not inclined to release the petitioner on bail. Accordingly, his payer for bail stands rejected.
