He was issued charge memo No. G/980/2023-2, dated 20.03.2023 followed by revised charge memo No.G/980/2023-2 dated 19.04.2023 alleging that while she was working as Sub-Registrar R.O(OB) Nellore and presently working as Sub-Registrar, Stonehousepet, SPSR Nellore District she involved certain irregularities and failed to perform duty in preservation of records of the R.O(OB) resulting missing of certain registers. The petitioner later submitted a statement of defence on 17.04.2023 refuting aforesaid charges and the enquiry is stated to be pending. Now the respondents are in process of affecting promotions to the post of District Registrar. As per the seniority list prepared, the petitioner stands at Si.no.4. In view of the pendency of the disciplinary proceedings, she apprehends that her case would not be considered for promotion. Heard Mr.V.Ravichandran, learned counsel for the 2. petitioner and learned Assistant Government Pleader for Service- I appearing for the respondent Nos.1 to 4. 5 W.P.NO.16898OF 2025 Learned counsel for the petitioner contends that in view of 3. pendency of ongoing departmental proceedings, which otherwise ought to have been completed in three months in simple cases and in complicated cases within six months, as per the timeframe fixed in G.O.Ms.No.679, General Administration (Services-C) Department dated 01.11.2008, and in G.O.Ms.No.91, General Administration (Service.C) Department, dated 12.09.2022, and in view of inordinate delay, petitioner is deprived of promotion. Learned Assistant Government Pleader appearing for 4. respondents that the ongoing inquiry will be completed within reasonable time, in terms of timelines prescribed by the General Administration G.O.Ms.No.679, Government in (Services-C) Department dated 01.11.2008, and in G.O.Ms.No.91, General Administration (Service.C) Department dated 12.09.2022. In view of the above observations, the respondents are 5. directed to consider the case of the petitioner for promotion to the post of District Registrar, without reference to disciplinary proceedings in pursuance of charge memo No. G/980/2023-2, dated 20.03.2023 followed by revised charge memo i 6 CGR,J W.P.NO.16898OF 2025 No.G/980/2023-2 dated 19.04.2023. It is further directed that the r respondents shall complete the pending inquiry within a period of three (03) months from the date of receipt of a copy of this order.
