BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER 11.12.2025 Heard Mr. J. Jini, learned counsel appearing for the accused applicant and Ms. T. Jini, learned Addl. Public Prosecutor for the State. This is an application filed under Section 482 of the BNSS, 2023 praying for pre-arrest bail in connection with Itanagar Women P.S. Case No. 74/2025 registered under Section 85/61/(2) (a)/117(2) of the BNS, 2023. The gist of the allegation as narrated in the FIR dated 06.11.2023 is that
Page No.# 2/3 the informant therein lodged an FIR before the Officer-in-Charge, alleging domestic violence, mental and physical harassment, assault, causing grievous hurt, cruelty, criminal conspiracy, attempt to murder or threats to life, word, gesture or act intended to insult the modesty of a woman, criminal intimidation and other serious offences against the informant’s husband. It was also alleged the husband of the informant i.e. the accused applicant is maintaining illicit relationship with the present applicant and both the husband and the present applicant conspired to eliminate her. After receipt of the FIR, the Police authorities have registered the Itanagar Women P.S. Case No. 74/2025 under the aforementioned sections. Vide an order dated 18.11.2025, a Coordinate Bench of this Court granted interim pre-arrest bail to the accused applicant. The learned counsel appearing for the accused applicant submits that in terms of the aforesaid pre-arrest bail order dated 18.11.2025, the accused applicant has already appeared before the investigating authority and got her statements recorded. He further submits that in view of her appearance before the I.O. of the case and since she is co-operating with the investigating authority, this Court should make the earlier interim pre-arrest bail absolute. He submits that the accused applicant in the event of her bail application being allowed, shall participate and co-operate with the investigating authority. The learned Addl. PP Ms.
T. Jini submits that the accused applicant has already appeared before the I.O. of the case and is co-operating with the investigation and therefore, she submits that she does not have any objection in the event of the prayer of the accused applicant is allowed, at this stage. On consideration of the aforesaid submission as well as on perusal of the
Page No.# 3/3 materials brought before this Court, this Court is of the considered opinion that interim pre-arrest bail order dated 18.11.2025 should be made absolute. Accordingly, the interim pre-arrest granted vide order dated 18.11.2025 is hereby made absolute with the same terms and conditions. In view of the aforesaid directions, the instant anticipatory bail application stands disposed of, as allowed. JUDGE Comparing Assistant
