The petitioner is apprehending his arrest in connection with Manatu P.S. Case No.22 of 2022, registered for the offences under Sections 406/407/408/409/420/120B of the IPC, pending in the Court of the learned JMFC, Palamau. 3. Learned counsel appearing for the petitioner submits that the petitioner is working on the post of Assistant Engineer under the Scheme of MNREGA. He further submits that the allegations are made in spite of utilizing the man power, the JCB machine has been used in executing the work for MNREGA. He submits that the work was to be executed by Junior Engineer and the others. Co-accused persons have been granted bail in A.B.A. No. 4066 of 2023 by order dated 13.07.2023, in A.B.A. No. 5872 of 2023 by order dated 10.08.2023, A.B.A. No. 1640 of 2025 by order dated 17.03.2025, A.B.A. No. 447 of 2025 by order dated 24.01.2025 and in A.B.A. No. 1300 by order dated 24.02.2025. He then submits that the petitioner has to take care of execution of the MGNREGA work. He then submits that petitioner has no criminal antecedent as disclosed in para-15 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations of assault is there. 2025:JHHC:29771 2 5. Considering that the petitioner is an Assistant Engineer under the MGNREGA Scheme and allegation is made that the JCB has been used by the other person for executing work in place human utilization. The petitioner has no criminal antecedent as disclosed inpara-15 of the petition and further co-accused persons have been granted anticipatory bail in the aforesaid ABAs, in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Palamau in connection with Manatu P.S. Case No. 22 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 24th September, 2025 Simran/
