JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 17-12-2025 Heard Mr. R. Sonar, learned counsel appearing for the petitioner. Also heard Mr. G. Tado, learned Additional Public Prosecutor for the State of Arunachal Pradesh. 2. This is an application filed under Section 483 of BNSS, 2023, whereby, the accused, namely, Shri Rai Jokhio has prayed for releasing him on bail Page No.# 2/3 after he was arrested in connection with Pasighat P.S. Case No.78/2025 under Section 109 of the BNS, 2023. 3. One woman has lodged the FIR alleging that the wife of the present accused had purchased a plot of land, and on that issue, the wife of the accused and her husband were having some discussion, the present accused being the husband of Ms Pit Modi attacked her husband with a sharp weapon and caused injury to him. 4. Mr. R. Sonar, learned counsel for the petitioner has submitted that Ms Pit Modi had purchased a plot of land from the victim but later on, some disputes arose on the issue of demarcation of land and upon that issue, there was a scuffle between both the sides. According to Mr. R. Sonar, learned counsel, victim was also armed with a dao and during the scuffle, he got injury. 5. In this case, the police have filed a charge sheet against the accused person. 6. Mr. G. Tado, learned Additional Public Prosecutor has objected to this bail application. 7. I have considered the submissions made by the learned counsel for both the sides. The accused was arrested on 13.09.2025 and till date, he is in judicial custody. Charges are yet to be framed by the trial court. This Court is of the opinion that accused person no longer deserves to be detained in custody. Therefore, this bail application is allowed. The accused, namely, Shri Rai Jokhio is allowed to go on bail on furnishing a bail bond of Rs. 25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Pasighat. It is further directed that the accused shall regularly appear before the trial court, on each and every date of hearing and if, he fails to do so, the trial court shall have the liberty to procure his attendance in accordance with the procedure as laid down by the law. 9.
