CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 22nd July 2025 P C : The present Writ Appeal was preferred against the judgment and order dated 29.04.2014 passed in W.P.No.30723 of 2013. The writ petition was filed challenging the order of suspension dated 31.08.2013 issued by the Indian Oil Corporation Limited, appellants herein, on allegations of adulteration of the petroleum products, suspension, however, was set aside by virtue of the judgment and order impugned and hence, the present appeal.

Learned counsel for the appellants would submit that notwithstanding the fact that the order of suspension was set aside by the learned single Judge, yet, nothing could prevent the Corporation from proceeding ahead to consider even terminating the dealership of the respondent in case there are
facts established in that regard against the respondent dealer.
3. It appears that the Corporation has not taken a call on the main issue of termination based upon the allegations against the retail dealer. The issue of inaction of the petroleum companies against retail dealers, who are alleged to be involved in adulteration, is also an issue which has come up before this We fail to understand as to why the petroleum Corporations are treating the retailers dealing in petroleum products with kid gloves although their activities of either adulterating petroleum products or short selling the same affect the public in general, who are already reeling under the impact of high prices of the petroleum products.
4. Bench in W.P(PIL).No.126 of 2024.
5. Considering the fact that the appellants are no longer interested to pursue the present matter, we leave the appellants free to pass appropriate orders on the complaint against the respondent notwithstanding the setting aside of the order of suspension by the learned single Judge.
6. Accordingly, the Writ Appeal is disposed of. No order as to costs.
