The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..declaring the action of the Respondents in abruptly terminating the assured life time Kalyan Mahostav services to Sri Bhramaramba Mallikarjuna Swamy, Srisailam on the name of the petitioners as illegal, arbitrary and consequently direct the Respondents to restore the life time Kalyan Mahostav services to Sri Bhramaramba Mallikarjuna Swamy, Srisailam on the name of the petitioners and pass such other order or orders …..”

The case of the petitioners is that the 1st petitioner has become the life time member vide I.D.No.200208060503, for performance of Kalyan Mahostav by paying Rs.3,500/- vide receipt No.67692, dated 01.05.2002, on his name on 17th of March and likewise, the 2nd petitioner and her husband have become the life time members for performance of said Kalyan Mahostav by paying Rs.3,500/- vide receipt No.19318, dated 06.09.1999, on their name on 26th of August. It is stated that the 3rd respondent while receiving the said subscription amount from the petitioners, has clearly stated that on the respective dates mentioned by the petitioners, Kalyan Mahostav will be performed on their name during their entire life time. While so, all of a sudden, the petitioners were served with an intimation vide Rc.No.G2/420/2011, dated 04.02.2011 stating that the life time membership is fixed at 10 years vide circular No.24, Rc.No.DPI/52200/2009, dated 10.11.2010 of the Endowments Department, thereby the 3rd respondent has stopped the promised Kalyan Mahostav services on the name of the petitioners. Aggrieved by the same, the present writ petition is filed. 3. Heard Mr.K.Gani Reddy, learned counsel for the petitioners and learned Assistant Government Pleader for Endowments, appearing for the repsonents 1 and 2. 4. Perused the material available on record. 3

On perusal of the contents of the affidavit and material papers filed by the petitioners, it appears that the petitioners are seeking the relief to extend the benefit of Nithya Kalyan Mahostav as the 3rd respondent has abruptly terminating their assured lifetime Kalyan Mahostav services to 3rd respondent temple. While observing the proceedings issued by the 3rd respondent temple vide R.C.No.B2/420/2011, dated 04.02.2011, it appears that the lifetime services in 3rd respondent temple was restricted only for ten years for the convenience of the devotees and further they have extended the period of three more years. 6. In view of the above proceedings, though the petitioners joined in the above said Kalyan Mahostav scheme in the years 2002 and 1999 respectively, their lifetime Kalyan Mahostav services was restricted for ten years only. The petitioners enjoyed the services till 2015, thereafter they have preferred this writ petition. 7. So, in view of the facts and circumstances of the case, it is not proper and correct to direct the respondent temple to continue the above said services to the petitioners, at this stage, after lapse of nine years. Further, the 3rd respondent has issued the proceedings dated 04.02.2011 for giving better services to the devotees as well as to the members of the scheme. As such, there are no merits in this writ petition. 4
