Mishra, A.P.P. 02/ 08.09.2025: Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Mayurhand P.S. Case No. 05/2025, registered under sections 303(2), 317(5) read with 3 (5) of the BNS, 2023, section 4/21 of MMDR Act, Rule 4/54 of JMMCR, 2004, Rule 7/9/13 of JMPIMT & Storage Rule, 2017, pending in the Court of learned Judicial Magistrate, Ist Class, Chatra. 3. Learned counsel for the petitioner submits that allegations are made that sand was stored in a particular land which was made for transporting to another place. He submits that petitioner has one criminal antecedent which is disclosed in para 10 of the petition. He submits that co- accused persons have been granted anticipatory bail in A.B.A. No. 2923 of 2025. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that petitioner is having criminal antecedent. 5. Considering that petitioner is having criminal antecedent and co-accused persons have been granted anticipatory bail in the aforesaid A.B.A, in view of that the petitioner is directed to surrender before the ( 2025:JHHC:27082 ) learned court within two weeks from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
