Re : CRAN 1 of 2025
1. This is an application for relaxation of conditions of bail.
2.
Learned counsel appearing for the petitioner submits that the petitioner has complied with the conditions and seeks for relaxation of conditions of bail.
3.
Learned counsel representing the State opposes such prayer and submits that the accused resides within close proximity of the victim and there is possibility of
threat to the victim and the public and seeks for dismissal of the application.
4.
Learned counsel appearing for the de facto complainant leaves the matter to the discretion of the Court.
5. It is found that by the order dated 19.05.2025, while granting bail, the following conditions were imposed:
“that the petitioner shall report to the Inspector-in- Charge of the concerned Police Station once in a fortnight. The petitioner shall not enter the jurisdiction of Balagarh Police Station except for the purpose of attending court proceedings and reporting to the Inspector-in-Charge of the concerned Police Station.”
6. It is found from the report of the State that the petitioner has reported to the Balagarh Police Station. It is informed by the State that though the victim has been examined but the other vulnerable witnesses are yet to be examined.
7. Considering the above, the condition to meet the Inspector-in-Charge of the Balagarh Police Station once in a fortnight is relaxed to the extent that the petitioner would meet the Inspector-in-Charge of the Balagarh Police Station once in a month. The other condition shall continue until further orders.
8. Accordingly, the application being CRAN 1 of 2025 is disposed of.
