The present Contempt Case is filed to punish the respondents under Section 10 to 12 of the Contempt of Courts Act, 1971 for willful violation and disobeying the order of this Court in W.P.No.13966 of 2021, dated
20.07.2021. 2. Heard Mr. G. Ramesh Babu, learned counsel for the petitioner and Mr. T. Balaswamy, learned counsel for the respondents. 3. By an Order dated 20.07.2021 in W.P.No.13966 of 2021, this Court passed the following order:
“Recording the limited request made by the learned counsel for the petitioner, Sri G. Ramesh Babu, and submissions of the learned Assistant Government Pleader for Revenue, the respondent No.3 – Revenue Divisional Officer, Madanapalle, is directed to complete the inquiry and submit report to the 2nd respondent enabling him to take appropriate action in accordance with law, within four weeks from the date of this order”. 4. The Respondent No.3 stated in Para No.5 of the Counter-Affidavit, which is reproduced hereunder:
“I submit that I have highest regard and respect to the orders of the Hon’ble Court and never violated the orders of the Hon’ble High Court either willfully or wantonly. The orders of the Hon’ble High Court have been implemented by the then RDO by passing the orders dated 14.03.2022 on conducting due enquiry. After submission of the orders of the then RDO dated 14.03.2022, the District Collector also passed suitable orders dated
25.10.2022. The RDO on receipt of order dated 25.10.2022 of the District Collector, remitted the matter directing the Tahsildar, Chowdepalli to pass speaking orders. On receipt of orders dated 25.10.2022 of the District Collector, the Tahsildar, Chowdepalli passed speaking orders dated 25.10.2022, on the same day. The petitioner received the copy of the order of the Tahsildar, Chowdepalli dated 25.10.2022 sent by RPAD on 14.11.2022.”
5. The learned counsel for the petitioner submitted that since the order has been passed by the respondents herein, nothing survives in this Contempt Case and requested this Court to close the Contempt Case. 6.
