Order 13/01/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.223/2024 registered at Police Station Mandavari, District Dausa for the offence(s) under Sections 303(2), 317(2), 132 & 221 of BNS and Section 4/25 of Arms Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that for the same offence another FIR No.638/2024 was lodged at Police Station Ramnagriya Jaipur (East) and the accused-petitioner was arrested and granted bail by the Court below vide order dated 19.12.2024, and in the said offence, the accused-petitioner is in custody since 06.12.2024. It is also contended that charge-sheet has already been produced before the concerned Court, the matter is exclusively triable by Magistrate and trial/investigation of the case may take
[2025:RJ-JP:1783] (2 of 2) [CRLMB-229/2025] considerable time, thus, the bail application of the accused- petitioner may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application and submitted the factual report. It is contended that the accused-petitioner is a habitual offender and was found to be involved in two other cases, therefore, considering the gravity of the offence, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on record.
5. Considering the fact that the matter is exclusively triable by Magistrate and charge-sheet has already been produced before the concerned Court. The accused-petitioner is in custody since long and trial/investigation of the case may take considerable time, thus, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Manjar Ali S/o Arif Ali in connection with FIR No.223/2024 registered at Police Station Mandavari, District Dausa shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
