Order 04/08/2025
1. The petitioner has preferred this third bail application under Section 483 of BNSS in FIR No.12/2024 registered at Police Station-Special Police Station (SOG), District-ATS & SOG for the offences under Sections 419, 420, 467, 468, 471 and 120B of IPC and Sections 3, 7 and 10 of Rajasthan Public Examination (Measures for Prevention of Under Means in Recruitment) Act, 2022 and Section 66D of IT Act.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner was working as a Chairperson of OPSJ University but he has resigned from the post of Chairperson in the year 2015, which has been accepted by the Board. The petitioner does not have authority to put his signature on any document. He further
[2025:RJ-JP:29623] (2 of 2) [CRLMB-8875/2025] submits that the petitioner is suffering from Sleep apnea (OSA) and he is behind the bars since 30.04.2023. Charge-sheet has been filed and the offences is triable by the Magistrate. Charge has been framed. The trial of the case may take considerable time, hence the bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application and submits that the petitioner is owner of the University and is facing charges for distributing the fake degrees with dishonest intention of monetary considerations. He further submits that there are three previous criminal antecedents pending against the accused-petitioner. He further submits that this is the third bail application, and it can be validly considered if there exists any change in circumstances. However, in the present case mere framing of charges cannot be considered as a change in circumstances. Therefore, this third bail application of the petitioner is liable to be rejected.
5. On consideration of the rival submissions and material available on record and deliberating all the facts and circumstances of the case, especially that mere filing of charge- sheet cannot be considered as change in circumstances but without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner.
6. Accordingly, the third bail application under Section 483 B.N.S.S. is dismissed.
