IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA COPC No.982 of 2025 Date of Decision: 12.09.2025 _____________________________________________________________________ Baziru & Ors. ……...Petitioners Versus Ashish Kohli …....Respondent Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Vaibhav Tanwar, Advocate. For the respondent: Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol, Mr. Vishal Panwar & Mr. B.C. Verma, Additional Advocates General with Mr. Ravi Chauhan, Deputy Advocate General. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) Before cognizance of the matter, if any, could be taken, Mr. Rajan Kahol, learned Additional Advocate General, has placed on record communication dated 11.09.2025, issued under the signatures of Director, School Education. Mr. Kahol, states that mandate contained in the judgment, alleged to have been violated, stands duly complied with. 2. Having carefully perused aforesaid communication as well as order dated 11.09.2025, which are taken on record, this Court finds merit in the contention of learned Additional Advocate General. Since respondents, after having considered the case of the petitioner in light of Yashwant Kumar’s case, have rejected the representation, no action of the respondents can be said to be contumacious. 2 3. In view of the above, present petition is disposed of reserving liberty to the petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to order passed in purported compliance of the judgment, alleged to have been violated. Notice issued to respondent is discharge. September 12, 2025 (Sandeep Sharma), (Sunil) Judge
