20.05.2025 Court No.28 Item No. 62 tbsr Rejected CRM (A) 1633 of 2025
In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023/under Section 438 of the Code of Criminal Procedure, 1973 in connection with Murshidabad P.S. Case No.248 of 2022 dated 07.05.2025 under Sections 341/325/326/307/427/34 of the Indian Penal Code and under Section 25(1)(a)/27 of the Arms Act.
And
In the matter of: Hasen Sk. & Ors. ….Petitioners. Mr. Debapriya Samanta Mr. Suhotro Palit Mr. Akash Kumar Chakraborty
…for the petitioners.
Mr. Imran Ali Mr. Tirthankar Dhalli
…..for the State.
Learned counsel appearing on behalf of the petitioners submits as follows. The de facto complainant and his associates attacked the petitioners. They fired shots and themselves got injured. A case was started by the petitioners. As a counter-blast, the instant proceeding has been initiated.
Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the statements of the witnesses who had taken the names of the petitioners and refers to the injury report. The victim received bullet injury. Charge sheet was submitted in 2022, but the petitioners had absconded.
In view of the serious allegations levelled against the petitioners and the incriminating materials present in the case diary, I do not consider this to be a fit case to grant anticipatory bail.

Accordingly, the application for anticipatory bail is rejected.
