The applicant herein has filed the present application u/s 528 BNSS for quashing the entire proceedings of Complaint Case No. 1425 of 2022, (Anwar Ali vs. Pradeep), under Section 138 of the Negotiable Instrument Act, P.S. Didauli, District Amroha as well as summoning order dated 31.8.2022 issued by the Second Additional Civil Judge (Junior Division)/Judicial Magistrate, Amroha. 3. Sri Kripa Shankar Yadav (A/K0815/2024), learned counsel for the applicant seeks to withdraw the present application with liberty to file fresh on account of technical inherent defects. However, he submits that the certified copy be returned subject to furnishing of the photocopy. 4. Learned AGA has no objection to the same. 5. The application is dismissed as withdrawn with aforesaid liberty. 6. Office is directed to return the certified copy of the document which has been filed subject to furnishing of the photocopy.
