This criminal petition under Section 482 of Code of Criminal Procedure, 1973 has been filed praying for quashment of the F.I.R. registered being Changlang P.S. Case No. 45/2019, under Sections 468/471/381 of Indian Penal Page No.# 3/4 Code, 1860. The F.I.R. was lodged by Dr. H. Tangjang, Medical Superintendent of District Hospital Changlang before the Officer-In-Charge, Police Station Changlang alleging fraudulent withdrawal of money from APCMUHIS Account No. 34739773661 of State of India, Changlang. Upon receipt of the said F.I.R., a case has been registered as Changlang P.S. Case No. 45/2019, under Sections 468/471/381 of Indian Penal Code, 1860. The petitioner, who was working as Dealing Assistant at the relevant point of time under the Health Department, particularly under the Scheme, has been indicted in the said case. Mr. G. Tado, learned Additional Public Prosecutor, by placing the Status Report, submits that there is no evidence against the petitioner- Shri Amin Hussain regarding his involvement in the alleged fraudulent transaction. As per the FSL Report, the signature and handwriting of the accused/petitioner and other co-accused do not match with the signature on the leaves of the cheque and authority letter seized from SBI Bank, Changlang. As no prima facie case against the accused/ petitioner and others could be established and considering that the case was pending for long without any headway, the Investigating Officer has submitted the Final Report. Considering above, since there is no materials/evidences which could establish the involvement of the accused/petitioner in the alleged fraudulent transaction in the case and for that reason the petitioner appears to have not pressing the present petition, I deem it appropriate to close the same as there requires no determination for quashing the F.I.R. against the accused/petitioner. Accordingly, the criminal petition stands closed and disposed of.
