Earlier he was issued charge memo dated 31.05.2008, and as the disciplinary proceedings were not being concluded, the petitioner preferred W.P.No.4715 of 2020, which came to be allowed by an order dated 29.10.2024, quashing the charge memo. Consequently, the respondents have issued proceedings dated 07.01.2025, dropping the disciplinary proceedings and ordering to release consequential benefits entitled by him. Further, even the suspension period from 23.05.2008 to 17.07.2009 was ordered to be treated as on duty for all purposes now the respondents have issued memo dated 21.02.2025, for preparation of panel for inclusion of candidates in the cadre of Superintendents as well for affecting further promotions. However, the name of petitioner is not reflected in the said list. Therefore petitioner made representations dated 05.05.2025 and 21.05.2025, before respondent Nos.2 and 3, requesting to consider his case for promotion by including his name in the panel, which is stated to be pending. Learned counsel for the petitioner submits that as this Court in W.P.No.4715 of 2020 has categorically directed that petitioner is entitled to be extended all consequential benefits, denial of promotion and non-inclusion of the name in the panel is clearly arbitrary. However, as the petitioner has made representations stated above, let the 2^^ respondent be directed to consider and dispose of the same, in accordance with law. as 4.
